  38. Software-Quelle GmbH grants you a limited license to use
  39. the SHAREWARE VERSION of "SQCBW" during a 21-days
  40. evaluation period for the express purpose of determining
  41. whether "SQCBW" is suitable for your needs. At the end of
  42. this 21-days evaluation period, you must either purchase a
  43. license from Software-Quelle GmbH for continued use of
  44. "SQCBW", or discontinue using "SQCBW".

  50. The EVALUATION COPY of CBW.EXE sometimes shows a license
  51. reminder screen.

  55. After registration of your license you receive a license
  56. number, which enables you to install a licensed version of
  57. CBW.EXE on your hard disk. The licensed version of CBW.EXE
  58. does NOT show the license reminder screen.

  66. DISTRIBUTION OF THE SHAREWARE VERSION

  71. VERSION of "SQCBW" only for the trial use of other
  72. individuals in accordance with the limitations identified

  89. permitted and encouraged to post the SHAREWARE VERSION of
  90. "SQCBW" for downloading by their users, as long as the
  91. above conditions are met. Though a fee may be charged for
  92. BBS access, NO FEE may be charged to specifically access or
  93. download the "SQCBW" shareware files.

  100. Purchasing a single-user license for "SQCBW" allows you

  102. *      to use "SQCBW" on a regular and/or continuing basis
  103. *      to use "SQCBW" on any and all computers available
  104.        to you, provided you do not operate "SQCBW" on more
  105.        than one computer or terminal at a time. See the
  106.        file REG.FRM for a single-user license.
  107. *      to receive technical support (by fax, mail, or
  108.        various electronic services such as CompuServe),
  109. *      to get discounts on future versions.

  112. With your purchase, you will receive a license number,
  113. which you should enter at the request of the setup utility
  114. SETUP.EXE. The license number contains the version
  115. descriptor and is valid for all further versions
  116. corresponding to the version descriptor.

  134. public, or private users of "SQCBW" must be licensed. We
  135. offer quantity discounts as well as multi-user licensing.

  140.         LIMITED WARRANTY FOR THE LICENSED VERSION:

  143. For a period of 1 year from the date of receipt Software-
  144. Quelle GmbH warrants that
  145.  
  146. a)     the licensed version of "SQCBW" will perform
  147.        substantially in accordance with the accompanying
  148.        documentation
  149.  
  150. b)     any hardware accompanying the licensed version of
  151.        "SQCBW" will be free from defects in materials and
  152.        workmanship under normal use and service
  153.  
  154.         CUSTOMER REMEDIES FOR THE LICENSED VERSION:

  157. Software-Quelle's entire liability and your exclusive
  158. remedy shall be, at Software-Quelle's option, either
  159.  
  160. A)     return of the price paid or
  161.  
  162. B)     repair or replacement of the software or hardware
  163.        that does not meet the limited warranty and is
  164.        returned to Software-Quelle GmbH with a copy of
  165.        your receipt. Any replacement software or hardware
  166.        will be warranted for the remainder of the original
  167.        warranty period.

  169.                    NO OTHER WARRANTIES:

  172. To the maximum extent permitted by applicable law, software-
  173. quelle disclaims all other warranties, express or implied,
  174. including but not limited to, any implied warranty of
  175. merchantability or fitness for a particular purpose.
  176. Specifically, Software-Quelle GmbH makes no representation
  177. or warranty that the software is fit for any particular
  178. purpose.

  180. Software-Quelle GmbH shall not be liable for any damages
  181. resulting from the use of this software, including but not
  182. limited to, loss of profit, data or use of the software, or
  183. indirect, special, incidental or consequential damages or
  184. other similar claims, even if Software-Quelle GmbH has been
  185. specifically advised of the possibility of such damages. In
  186. states were such limitations are not legal "SQCBW" must not
  187. be used.

  191.            GOVERNING LAW AND GENERAL PROVISIONS

  197. interpreted and governed by the laws of the Federal
  198. Republic of Germany. If any provision is found void,
  199. invalid or unenforceable, it will not affect the validity

  201. shall remain valid and enforceable according to its terms.

  203. writing signed by you and a specifically authorized
  204. representative of Software-Quelle GmbH. All rights not
  205. specifically granted in this License are reserved by
  206. Software-Quelle GmbH.
